Both the Board of Directors and the management company consistently receive complaints regarding violations of the governing documents and requests for stringent enforcement. Bahia Lakes is a beautiful deed restricted community.   One of the benefits of a deed restricted community is that a specific behavior is expected by its residents.   The Board of Directors and the Community Development District have worked diligently to create an enforcement plan for street parking.   The Board of Directors and Management have also worked closely to create an enforcement plan for street parking, commercial and recreational vehicles kept on property, trash cans, etc.  Bahia Lakes Rules and Regulations from the Declaration of Covenants, Conditions, and Restrictions identifies specific expectations of all residents and the consequences of not adhering to these Rules. 
The intent of this plan is to have a positive effect on our property values and to create the harmonious living conditions everyone requested by choosing to live in a deed restricted community.

RULES AND REGULATIONS :  Street Parking: Article X – Use Restrictions, Section 9 – Vehicles
“The parking or storage of automobiles except in designated areas of the Properties is prohibited without express prior written permission of the Association.  Vehicles are to be parked in the garage.  In the event, all vehicles cannot be parked in the garage, then such vehicles(s) must be parked in the driveway of the Lot.  The overnight parking of vehicles of any kind in the Common Area is prohibited except in areas designated as parking areas by the Association; provided, however the overnight parking of any of the following vehicles is prohibited upon any areas of the Properties: trucks or vans used for commercial purposes, mobile homes, trailers, boats, boat trailers, truck campers and any trucks or vans with a payload capacity of more than 3/4 ton unless parked fully within a closed garage.;…”

Street parking is a major problem in the community.  The garbage trucks are not able to get down the streets and the postal carrier has advised that often the mailboxes cannot be accessed which could result in garbage not being collected and mail not being delivered. 

The Community Development District, Board of Supervisors, has authorized the Homeowners’ Association to tow any vehicles parked in the street overnight. 
The following procedure applies:
1.  Any vehicles found within fifteen (15) feet of a 
fire hydrant or within thirty (30) feet of a STOP SIGN is subject to being towed without warning (Day or Night).
2.  When feasible, a notice (sticker) will be attached to the vehicle informing the vehicle’s owner that the vehicle is parked in violation of this policy and will be towed as stated on the notice. 

The Homeowners Association will further enforce no street parking by fining the resident where the vehicle is parked as follows:
1.  Upon receipt of notice of a violation, a “Letter of Violation” will be mailed to the Homeowner with a photo of the vehicle parked in front of the home.  In accordance with Florida Statute, this is a 5-day notice prior to a fine of $100 per day. 
2.  If a neighbor or guest of a neighbor is parking in front of your home, it is your responsibility to put your neighbor on notice to move the vehicle or advise the HOA as to the residential address responsible for the street parking. 
3.  The HOA has 3 Visitor Parking Lots (2 on Seminole Sky Drive, at 1108 & 1136 and 1 at 703 Fern Leaf Drive) for Residents who intend to have a gathering where all the vehicles will not fit in the driveway or where work is being conducted on the driveway.  Overnight parking in these lots requires a permit which is valid for no more than 14-days and must be for a specific reason.  If you plan to have a gathering that requires overnight parking, please submit a Request Form in advance of the event to the 
BOD or the HOA management company at: HYPERLINK "mailto:Amanda@qualifiedproperty.com" Amanda.m@qualifiedproperty.com  to receive permits.  The Pool Parking Lot is strictly for the use of Pool patrons and is not one of the Visitor Parking Lots
4.  Florida Statutes 316.1945 - Stopping, standing, or parking prohibited in specified places: prohibits parking within fifteen (15) feet of a 
fire hydrant, thirty (30) feet of a STOP SIGN or in such a manner to block a pedestrian’s use of the sidewalk

Commercial/Recreational Vehicles: Article X – Use Restrictions, Section 9 – Vehicles

There are some Residents bringing work vehicles home.  These vehicles must be parked inside the garage or all “commercial items”, including signage, must be covered or removed in order to comply.  Additionally, boats and trailers that are brought home, cannot be left overnight in the driveways and/or streets. 
Enforcement will be:
1.  Upon notice of the violation, a “Notice of Violation” will be mailed to the Resident citing the date and time of the violation.  In accordance with Florida Statute, this will be a 5-day notice prior to a fine of $100 per day. 
2.  If the vehicle is parked in the street overnight, the vehicle will be towed without warning if found on the street – at any time. 

Association-owned Visitor Parking Lots:
Bahia Lakes visitor parking lots (
2 on Seminole Sky Drive, at 1108 & 1136 and 1 at 703 Fern Leaf Drive) are intended for temporary daytime parking of guests and visitors; overnight parking requires prior coordination and approval from the HOA.

Please advise your guests to park in the properly identified parking areas. 
Vehicles found on the grass in community property will be towed without further warning.
